High Court overrules CBSE revaluation conditions

CBSE had, on June 28, issued a notice restricting the re-evaluation to 12 subjects and upto 10 questions per subject. However, in a major relief to the students, acting on a plea filed by four students, Delhi High Court has passed interim orders on Thursday asking CBSE to reevaluate the answer sheets of all Class XII students who have applied for fresh scrutiny of their papers.

A bench of acting Chief Justice Gita Mittal and Justice C Hari Shankar said “The relief is not confined to the petitioners and shall apply to all similarly situated students who seek reevaluation of their answer sheets." The bench further specified “CBSE shall conduct the re-evaluation of the answer sheets of the petitioners as have been applied for by them without the prohibition contained in condition numbers (i), (iii) and (vii) of the notice dated June 28, 2017. CBSE shall accept all applications for re-evaluation in all subjects.”

CBSE notice has limited the re-evaluation subjects to Physics, Chemistry , Biology , Business Studies, Economics, English (core & elective, both CBSE & NCERT), Hindi (core & elective), Mathematics, and Accountancy. The students’ plea was for expanding the scope of subjects allowed for re-evaluation.

In addition to striking down the condition of subjects and no. of questions per subject, the court also struck down CBSE’s notice that said that a revised marksheet would be issued only if the marks increased by five or were reduced by one.
